Gas Station Weed vs. Dispensary Cannabis
Understand the Difference: Ohioans will soon have the ability to purchase legal, safe, regulated cannabis from licensed dispensaries. With this new option, it is crucial Ohioans know the differences between purchasing untested, intoxicating hemp products from unlicensed stores and the products available at state-licensed cannabis facilities.

Rulemaking Process & Potential Impact
On November 7, 2023, Ohioans passed Issue 2, legalizing adult-use marijuana. The new Division of Cannabis Control will begin the process of awarding adult-use dispensary licenses to existing medical marijuana companies in June. Unfortunately, communities across the state have passed temporary moratoriums and permanent bans on adult-use dispensaries as they wait for more information about program rules.

Comparison of Issue 2 Recreational Marijuana Initiative and Proposed Revisions
by the Ohio General Assembly
Within days of the passage of Issue 2, various members of the Ohio General Assembly have proposed legislative changes to a number of the provisions of the new law. As the 136th session of the Ohio General Assembly got underway, the Ohio Senate proposed a new bill aimed at reforming the passed statute, SB 56, followed by a substitute bill. The Ohio House has now introduced their own bill, HB 160.

Considerations for Regulating Intoxicating Hemp Products
The proliferation of intoxicating hemp products in many retail outlets has led to concerns about their safety, quality, and marketing among policymakers and public health experts. Many states have taken steps under state law to regulate intoxicating hemp product. According to a recent Reason Foundation report, Ohio is currently among a minority of states with minimal or no regulations on these products.

Moratoriums for Ohio Adult Use Marijuana Operators
As medical cannabis companies gear up to expand their operations for the broader consumer market, 47 Ohio localities have active moratoriums on adult-use cannabis operations in their jurisdictions as of March 31, 2024, according to the Ohio State University’s Drug Enforcement and Policy Center (DEPC) within the Moritz College of Law.

A recent Ohio State University’s Drug Enforcement and Policy Center study estimates the potential annual tax revenue from legalizing marijuana ranges from $276 million to $403 million in the fifth year of an operational cannabis market.
